There appears to be no specific requirement to disclose commissions. Indeed, I would think that as “publishers” affiliate marketers would be expected to make a charge for publishing advertising material – be it a set rate or performance based.
After all, don’t we all expect a salesperson to be rewarded with an incentive for helping us benefit from a product or service?
Certainly, there are requirements in some sectors in Australia to disclose rewards, such as in finance or in real estate.
Anyway, Matt, although you live in Australia, your .com web address implies you could be based in the USA (or anywhere). So – you’re no doubt wise, indeed obliged, to comply with the law of any and all jurisdictions in which you trade.
Which is essentially the advice of the ACCC.
